Understanding COVID Disability Assistance: Your Rights and Support Options

The COVID-19 pandemic has left a deep and lasting impact on all our lives, including millions of Americans who were infected since the initial outbreak in 2019. Many have had to endure long and difficult recoveries, complicated by persistent symptoms that have become commonly known as “long COVID.” If you or someone you love is living with long COVID, it’s important to know that there are resources available to help.

Is Long COVID A Disability?

It can be. Under the Americans with Disabilities Act (ADA) and Sections 504 and 1557 of the Rehabilitation Act, long COVID may qualify as a disability if it substantially limits one or more major life activities. Symptoms like fatigue, brain fog, shortness of breath, or mental health issues can make it difficult to work, go to school, or care for yourself as you once did. If that’s your experience, you may be able to obtain reasonable accommodations under the ADA.

Legal Rights and Workplace Accommodations

Employers must provide reasonable accommodations for employees with qualifying disabilities unless doing so would cause significant difficulty or expense, referred to as an “undue hardship.” Accommodations may include flexible work schedules, remote work, or adjustments to workload, among others. Public services and educational institutions like colleges and universities also have a duty to accommodate individuals with disabilities, like those affected by long COVID.

Accessing Disability Benefits

If your long COVID symptoms are keeping you from supporting yourself with a job, you may be eligible to claim Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI). This application process is not always the easiest, but here at Pandemic Legal, we’re well-equipped to help you navigate this process.
